personally I would say it is and would probably use a standard license, BUT, if a CC license is strong enough to protect a max patch then it seems like it would be a more 'recognisable' license to people who use max. The only differences are cosmetic; two abrstractions are changed to subpatches, the objects are moved closer together to save space (but retain overall positioning), and patch cables are aligned.
