The Salon article that someone linked to earlier summarizes the facts of the case pretty well. The contemporaneous testimony of the victim (under oath, in a court) is reproduced online starting here:

Anyone who can read that (especially the second half) without thinking that Polanski deserves punishment for his actions........

The 'justifications' that are being paraded online are just ridiculous.

-'his mum died in the Holocaust' - so fucking what? 6 million people died in the Holocaust. Are all their descendants allowed to rape children, or just ones who direct a few arthouse films?

-'his wife was murdered' - 8 years previously. Very sad. After 8 years he should be at the point where he doesn't need to console himself with 13 year-old girls.

-'the girl looked much older' - pictures of the victim from the time have been reproduced on numerous websites. All I can say to that is 'bullshit', she looks 16 at best. Polanski was 44. Probably also worth mentioning here that Polanski was having an affair with Natassia Kinski when she was 14.

-'it was 30 years ago' - utterly irrelevant. Concentration camp guards etc. are still pursued 60 years on. The only reason that it's dragged on this long is that he's been too busy swanning round Europe attending sycophantic festivals and running from justice.

Fuck the creepy old bastard, send him back to the US and make him do his time.

Smoking Gun and The Salon are obviously biased... just read the tone of the articles. Smoking Gun is a freaking mugshots website and Salon is a gossip tabloid, they try to get the widest audience possible.

"It seems that Roman Polanski's arrest for raping a 13-year-old girl 32 years ago couldn't have come at a better time for Brett Ratner. Just hours before Polanski was busted in Switzerland, Ratner taped at interview with BlogTalkRadio's "Movie Geeks United" show and announced that he'll produce a sequel to "Roman Polanski: Wanted and Desired."

"Wanted an Desired" is a Marina Zenovich's 2008 documentary that shed new light on the 1977 trial. Ratner believes that he can deliver a sequel that will try to convince the world that Polanski's case should be thrown out.

How is the material on the Smoking Gun biased? It's a transcript of the victim's testimony in court - a matter of record, not editorial material / opinion. Unless you're suggesting they've fabricated the material?

She said Polanski later went into the bathroom and took part of a Quaalude pill and offered her some, as well, and she accepted.

Q: Why did you take it?

A: I don't know. I think I must have been pretty drunk or else I wouldn't have.

So here she is, at 13, washing down a Quaalude with champagne, and then Polanski suggested they move out to the Jacuzzi.

Q: When you got in the Jacuzzi, what were you wearing?

A: I was going to wear my underwear, but he said for me to take them off.

She says Polanski went back in the house and returned in the nude and got into the Jacuzzi with her. When he told her to move closer to him, she resisted, saying, "No. No, I got to get out."

He insisted, she testified, and so she moved closer and he put his hands around her waist. She told him she had asthma and wanted to get out, and she did. She said he followed her into the bathroom, where she told him, "I have to go home now."

Q: What did Mr. Polanski say?

A: He told me to go in the other room and lie down.

She testified that she was afraid and sat on the couch in the bedroom.

Q: What were you afraid of?

A: Him.

She testified that Polanski sat down next to her and said she'd feel better. She repeated that she had to go home.

Q: What happened then?

A: He reached over and he kissed me. And I was telling him, "No," you know, "Keep away." But I was kind of afraid of him because there was no one else there.

She testified that he put his mouth on her vagina.

"I was ready to cry," she said. "I was kind of -- I was going, 'No. Come on. Stop it.' But I was afraid."

She said he then pulled off her panties.

Q: What happened after that?

A: He started to have intercourse with me.

At this point, she testified, Polanski became concerned about the consequences and asked if she was on the pill.

No, she told him.

Polanski had a solution, according to her.

"He goes, 'Would you want me to go in through your back?' And I went, 'No.' "

According to her, that didn't stop Polanski, who began having anal sex with her.

This was when the victim was asked by the prosecutor if she resisted and she said, "Not really," because "I was afraid of him." She testified that when the ordeal had ended, Polanski told her, "Oh, don't tell your mother about this."

He added: "This is our secret."

But it wasn't a secret for long. When the victim got home and told her story, her mother called the police.

That was ten years ago. Let the woman have her peace, all you people wanting blood aren't helping anything. The judge reneged on a deal, screwed it all up for everybody, especially the victim, but yeah, we're sooo concerned about her and how she feels right? Bullshit, it's just drama and focused rage and hatred for his actions that people care about, not justice, not in the least.

She received some sort of undisclosed financial settlement from him, I wouldn't be surprised if this letter was related to that in some way. She may not want it all brought up again at this stage in her life, and that's understandable. But the only person to blame for that is Polanski, for going on the run for 32 years.

No, the media is to blame for that, and the court of public opinion that hashes this out for their own satisfaction.

Completely disagree. If he'd have done his time 32 years ago that would have been the end of it, and no-one would care about the victim now. I actually think it's very strange of her to complain about the media spotlight after she's given a number of interviews about the incident over the years, and allowed herself to be photographed at media screenings of Polanski's films, but that's just my opinion....

Besides, her wishes at this stage are irrelevant - the justice system serves society as a whole, not individuals, and society views the crime in question as extremely serious and worthy of punishment. Why should a child rapist get let off the hook just because the victim, following receipt of a substantial amount of money, says she forgives him? What about if instead of forgiving him, she asked that all her male relatives could kick him to death - would you support her wishes then, as well?
