Further copyright issues with sampling...

Just saw this on Google news.

I guess the poll on who makes 100% own material might have more merit than I originally thought.

It is going to be interesting how this all plays out. What with last year's george clinton sampling copyright issue, and now this.

However, it is something that we are going to have to deal with, since we are not the powers that be. We have to deal with the laws that are handed down to us, unless any of us want to become politicians?

It appears that for this moment in the history of the species, sampling is going down. Unless you are very up front, and agree to the royalties.

heh, excuse me, the timing pleases me as I was alone on the '100% original' thread championing the literal definition of 100% original, whereas my peers were like 'my stuff isnt 100% original, but it is 100% original because <insert wishy washy existential horse-shit here, not a chance of standing up in court nor does it bare any relevance to arithmetic or the meaning of the word original>'

while the connotations are grave, the moment is bliss :D

ordered to pay $3.5 million in punitive damages and at least $733,000 in direct damages plus interest to Armen Boladian, owner of Bridgeport Music and Westbound Records.
What I want to know is how much of this money is going to the Ohio players? My guess is very little.

I think that you are right to an extent. However, I know that I use sampled one-shots for drums. I think that this is probably legit as far as sampling goes. I know that I could use a synth as a tone generator to layer my own kicks and hats, etc....but what if you wanted something from a real kit?

In this area, I still think it is ok to use samples, however, I then use all original material for everything else, and my own grooves, not MIDI grooves off the net. In that vein, I would still consider my material ~100% original. I still think that using sampled one-shots to create a drum kit in impulse doesn't truly qualify as not using 100% one's own material when it somes to composition.

Never liked sampling from other tracks. Probably never will.
