It might be a good idea to start an Open Discussion forum for such OT threads. This forum is dropping in quality as a useful support resource for users.

go ahead. just dont complain if they take up alot responses. i mean if you really dont like off topic threads, then go post the same thing on the tsunami thread. alot of us here are consumers of monster cable so it is a bit of a concern for us.

I'm listening to music through monster cables right now - music made with Live 4!
The only way to turn a mildly on-topic thread like this one into a truley off-topic thread, is to call it off-topic and then turn the thread into a debate about whats on and off-topic!
If M-Audio, or Novation, or any other midi-controller manufacturer did the same crap Monster Cable is pulling - would you call the subsequent thread off-topic?
Do we need to have a look at the definition of "General" ?
Concerned with, applicable to, or affecting the whole or every member of a class or category:
Well, monster cables to due indeed affect the whole sound that is coming from Ableton Live - if you do choose to use them.
Seriously man this thread was on-topic till some folks started thread-crapping.

Clearly the only lonely heart is yours. Attitude like yours may really leave you without friends.
This forum is the best one known to me, it is not coincident that there are many succesfull artists here not just geeks and wannabies. having open mind, ears and eyes is one of the conditions to create art that finds resonance in others. If you isolate yourself from the world the world will neither like neither want to hear you.
Tolerance is another quality present in developed cultures.
So it might be more usefull to understand and enjoy the variets of subjects and the beauty of democracy and tolerance, live and let live

back to the topic, this is really unbelievable, how can a common word found in all dictionnaries be protected ?
I thought you could protect "monster cable" as a whole but monster ???
A made-up name (like "nomster" ) would make sense but here this means that any company using a common name in its brand name could sue another company for using it too. How can that be ?

good point Chris J, it would set precident.
overstock.com could sue any company having an "overstock sale"
American Express could sue any company using "American", and there are a few of those! or the word "Express" for that matter.
I'm glad this guy in Colorado is standing up to them, hopefully it will bring attention to any judge who is sober that this a precident that cannot be made.

Still if Disney who are not really a small companies with no funds to stand up against a lawsuit, settled for some private arrangement, that means they knew they couldn't win.

well not necessarily, if the settlement was lest than court fees would have been.

but aren't the court fees paid by the one who loses in the end ? Couldn't Disney pay for 2 or 3 years of battle and get their money back if they were sure to win ?
From what i gathered the settlement is a yearly paiement to use the 'monster' word and % on incomes.

Well, the reports have been saying thar Disney "settled", whatever they mean with that. Could be that Disney didn't want negative publicity, as in Monster portraying themselves as the wronged small company going after Goliath, so they cut them a check.

Regarding trademark protection, there should be exemptions for words in the dictionary. Phrases, or made up words fine - but what if I went and trademarked "the" or "I" or "a" or "or"?
absolutely stupid.
I urge everybody in the music world to send a two line email to Monster Cable's customer support telling them that they've lost your business, and you're switching to Mogami or something.
