Can we get some clarification on the Terms of Service?

I noticed some of the AppStore reviews point out the Terms of Service:

“You grant Ableton (and its Authorized Third-Parties) a worldwide, non-exclusive, royalty-free, transferable and sublicensable, license to use, store, distribute, copy, modify, adapt, transform, reproduce, host, perform, display and communicate Your Sets including all contents and materials contained in Your Sets, without any compensation or obligation to You."

The developer response to those reviews merely pointed out that people retain the rights to their own music. Well gee, thanks.

Still doesn’t explain what the intentions are by sneaking this into the Terms of Service, which pretty much no one reads.

Why is this in there? What are Ableton’s plans to use peoples’ music? What are third party plans in addition to Ableton’s plans?

I'll try to ask around.
I highly doubt Ableton has any intention of using users' music to do anything with it, that's most probably some legal statements required because Sets can travel through internet waves to Ableton Cloud (don't quote me on this, though, this is just a guess).

This is the section of the Terms of Service.

4. Grant of Rights

(1) Under the condition that

a) You have registered and are holding a valid User Account; and

b) You have accepted these Terms,

Ableton grants to You a personal, limited, non-exclusive, revocable license to use Ableton Cloud in accordance with these Terms.

(2) As between You and Ableton, You retain all ownership of any intellectual property rights that You hold in Your Sets. You are solely responsible for any Sets You upload, share, or otherwise utilize on Ableton Cloud. Solely for the purpose of enabling Ableton to provide the Ableton Cloud services as contemplated herein, You grant Ableton (and its Authorized Third-Parties) a worldwide, non-exclusive, royalty-free, transferable and sublicensable, license to use, store, distribute, copy, modify, adapt, transform, reproduce, host, perform, display and communicate Your Sets including all contents and materials contained in Your Sets, without any compensation or obligation to You.

Seems common legal lingo for cloud sharing services, to allow them to actually do the cloud sharing thing legally.
