Hi all,

Something really weird happened. I bought ZenPad Mantra by EarthMoments and started a piece with
their Construction Kits. My final product was relatively similar to the original, yes, I'm a lazy @#$%,
but I liked it and uploaded as audio track of my video.

YouTube analysis claimed copyright on my audio track.

Copyright claim was for a song called "Jaya Ganesha by Buddha-Bar (BR)" ... I searched for that track and Oh Shit,
it sounds almost like the Construction Kit and very similar to my track. Other tracks of this album are like also
similar to other construction kits. I will be polite and will not start cursing to the producer of that album but,
have some decency man, at least, do not use construction kits "as is", show some creativity. Plus, mastering of that
album is so shitty, my eardrums' virginity was almost violated.

Can you get copyright for something that is very similar to construction kit ? Apparently you can. Is this ethical ?
I don't think so. Should a highly qualified music journalist write about this issue, YES, PLEASE ! As if AI generated
music is not headache, now we have to deal with this !

Yes, this is a thing now. It's been going on for a while.

For example I found someone who'd taken a demo track from the Native Instruments web site and uploaded it to Bandcamp for sale as their own production. They didn't even bother changing the name of it!

Also plenty of examples from producers on YouTube who've E.G. used AI as a starting point for a style then wrote their own tune around it, and ended up with a copyright strike. Another guy did a completely new on the fly compostion during a live stream, then got a strike when he uploaded it.

Even someone who was just playing keyboard patches/sounds to demonstrate it, getting a strike.

I am of the opinion that a demo track is subject to copyright in any case. That is in the nature of things and is obvious - if you think about it. Anyone could publish the demo tracks and claim them for themselves. Would that work? I don't think so.

In your case, you have already recognized yourself that your work has little depth of creation.

A purchased sample library is not, because this is about licenses of use. A preset of a synthesizer/sampler/... is not subject to copyright to the extent that it can simply be used commercially for the purpose of audio production. However, this copyright only covers the intended use. You should not relabel the preset in order to sell it under your own name as part of a preset pack.
