here is a great book on copyright law and how it has become a tool for powerful corporations to protect their own profits. yes, its about law, but it is a very easy, fast read with lots of interesting examples (i am no lawyer, just a big fan of sampling).

Hi Dave,

Some of the digital distributors use software to scan for "musical fingerprints" whilst encoding it for the various digital stores, so it might get spotted even if no human hears it, in this case someone like Interscope or tunecore would just refuse to distro for you.

When we sampled Radiohead we had to spend months trying to get it cleared, sampling is awkward because you have to clear it with both the Publisher & Sound Recording owner (Label or Artist), so you really have to decide whether its worth trying to sell it, if the sample is of anything major/famous then the Publisher & Label may both want an advance from you (or your label) which can work out expensive. Also the percentage of royalties the copyright owners can demand from you is unregulated in most territories, to get our Radiohead sample cleared we ended up having to give away 90% of our royalties on the track & an advance.

So basically is it worth you selling the track? You might find just giving away with the help of RCRDLBL or Hypem could be far more beneficial to your career.

Does anyone know about sampling from Speeches?? Like spoken word? Because its not like a song just someone else saying something?
