Why does Push keep reverting to in-key mode?

I'm using the latest beta so settings are supposed to be kept right? The velocity curve stays were I leave it now, but the scale mode always goes back to in-key. I would hardly ever want it in key. Shouldn't the key mode stay where you leave it too?!!
