A person can be whisked away. That it is highly unlikely is irrelevant to the fact that the government now has the legal structure to do it.

Even if it is a simple mistake, once the government has the power to put you in prison and you have no legal means to force a trail where you can present evidence of your innocence, you no longer live with freedom, but just by the whim of the government.
