well - I got a reply from him. He reckons its possible to upgrade the software and as such, he's not prepared to take it back if I've registered the software.

which is sly, because its not obvious the software is the educational license UNTIL you register!

He's offered me a $100 refund, bringing the cost of the software down to $200 excl delivery . $25 cheaper than any other place I've seen selling edu licenses....but also around the same price the full license goes for, 2nd hand.

the main thing that i want to do tho, is authorise reaktor one more time for a windows installation. Its not clear to me if this is possible with the edu license...

if it is, I'll take his offer - maybe try and drive him to a $125 discount.

The BS part is you saying that him opening it has anything at all to do with his ability to return it. He was lied to, period. His story is that the packaging had no EDU sticker on it etc..

True, but that is to NI, not to a dealer that lied. A rule is only as good as the word of the reseller who actually takes your money. I returned a copy of Tech Tool Pro a few years ago because the guy at the store who sold it to me said it had a feature it did not, that was not advertised on the box.
I had no proof of that, but the store in order to save face, had to return it for a full refund. To their advantage, years later when I had a use for TTP, I bought it from them, went out of my way to, since they were kind enough to fix their mistake the first time.
Bounce should get his money back no problem, if he in fact did ask the guy via email about whether or not R5 was an EDU version. That the guy is trying to talk him into it shows what a douche bag that guy is.

update: I've got my $125 refund - after receiving an email from NI a couple of days ago, it seems the academic license isnt all that crippled. I was told by NI support that its a once off discount, that future upgrades are priced the same - thats the drawback apparently. Oh - and I didnt get a direct answer, but it seems authorisation limits are the same too...

still - the guy was overcharging me for the edu license, by $75

at the end of the day, I got the edu license for $50 cheaper than any other american outlet I've seen it selling at - and customs didnt spot my package - works out to a juicy saving of 250 euro on the best I could have done in europe for a normal license...

However, I had to nag the ebay seller every 48 hours to get to this point too, each time ending my message with something amounting to 'respond or I'll let ebay and paypal sort it out' .....he sent me some truely bizarre off topic messages, and then you wouldnt hear from him for a couple of days & he also tried to convince me to accept the deal. Previous to sale I was getting responses in literally minutes, the advertisement spiel for his shop is that they have 24/7 support

Any broke european studenty types who dont want to use cracked software should consider buying an academic license from the USA via ebay. especially seeing as the NI licenses dont seem to be all that crippled....example - Kontakt 2 is 399 euro, I saw the academic license (new, boxed, etc) on ebay for $179 if I remember correct.
you gotta hope customs wont spot your package tho...
