:(

All my gear, clothes, gifts, cables and various other shit gone forever.

The real pain is the gear... it is replaceable but the custom templates I had on the controllers was worth hours and hours and hours of my time, I have the padkontrol templates backuped however but wasn't as on to it with the x-station.

To twist the knife, their final settlement offer was 428 euros, and according to them, that's the maximum they legally have to pay me.

It's not all bad tho, my private insurer has advised that I can claim the rest of the expensis with them, but only AFTER I have received the money and written confirmation of settlement from the airline.

If its taken them this long to decide my bag is lost, I don't want to think how long it is going to take them to actually pay me out.

Anyway... at least the process has begun and I should hopefully be on my way to an insurance payout sometime in the next few months, if not next year and can finally buy some more gear so I can play gigs again!

Thanks for all the advice
:x
that is so f'd up... but if they're gonna pay you...
what's the insurance for ? can't they cover the rest ?!
worst comes to worst...
Hijack one of their planes until they cough it up !!!

What airline was it? Did you pay extra to check baggage? Did you file an itemized claim of each piece of equipment and its value? Did you see any evidence that backs up their claim that the settlement offer was the minimum legal amount, like a written policy? They had a responsibility to deliver your cargo and are likely liable.

From a quick Google, the liability limit for lost baggage is 1,000 SDRs which apparently is about €1100 (though it varies from day to day). But it looks like they only have to pay what the items are worth and not what it would cost to replace.

But if your insurance is covering you its not likely to be worth arguing it.

Thats the thing, I didn't declare my expensive items with the airline, the promoter bookeded everything for me my ticket and the plane was a *sort of* connecting flight... quite dodgey and i learnt my lesson there.

However I do have my gear declared with private insurance.

Vueling Airlines in Spain fucked around, they wouldn't answer my calls, emails took forever, they we're rude at the airport and they have offered me way under their legal limit, I just can't be fucked dealing with them anymore. I could fight, but I can't be bothered, i know that's what they want, and it sucks.

Agree, sounds like it would be easier to deal with the insurance company, gotta pick your battles.

i've lost my gear bag many many times!! One time for 3 month then it came back home. During that time they told me i could buy some new gear for a maxium of 1600 euros that should be refound if i sent all the recives. Got the money and the bag but a bounch of stress too(iberia). You should ask for vueling's refound policy and keep waiting, they usually come at one point

The latest update in the Saga

I got a call from my Mother today, the bag has turned up at Customs in New Zealand, unlabeled and apparently, damaged severely. Customs are holding it for a few days as the paper trail leading up to its arrival in NZ goes all around the world and seems quite suspicious.

Fortunately, I keep my parents contact details on the inside of my bag for just this reason.

The airline have declared it officially lost, so as far as they no, it's not in NZ... the guy at the Airport said he hasn't seen a case like this before.

My sister is going to pick it up for me in a few days and we will asses the damage over skype! (I live in melbourne)

At least now, when I make my claim, I can prove beyond a doubt everything that was in the bag.

It's kind of exciting now, I just hope no one stashed any drugs in it or anything.

I hope there will be a movie about the travels of your bag featuring a cute French chick and 3 thuggish Irishmen.
