My live config is for 24b 48 khz audio but when I use freeze and then flatten live is generating a 32b 48 khz file.
I was expecting the freeze function to use user defined settings, was I wrong ?

This is normal behaviour.
The reason is that Live's internal resolution is 32 bit floating point (at the mix (summing) points 64 bit).
Also have a look what the manual is writing for that:

30.2.6 Recording internal sources at 32 bit
Audio that is recorded via internal routing will be identical to the source audio, provided
that the recording was made at 32 bits. To ensure neutral recordings of plug-in instruments
and any audio signals that are being processed by effects plug-ins, internal recording at 32
bits is recommended. ...

So freezing in 32 bit ensures that the resulting audio file has an identically (audio) quality as the track has before freezing.
But, as I remember, there was an old thread with a discussion about this behaviour.
