Concerning Intellectual Property law:
If the part sampled is inherent to the identity of the song then it is uncool in court.
I think this means that a sample is a breach of an artists copyright if it samples an identifiable part of the song.
It is sort of clear but remains ambiguous enough to be clarified in court and follow whatever precedence they want to set.
I guess the same idea applies to the remix.
