Default Warp mode not working (preferences)

sup all.

on both PC (Windows ME) and Mac OS 10.2.4, I cannot get loops' default warp settings to take.

I have tried restarting the application and working with fresh loops (no .ASD) file.

here is what I do:
1. open preferences and check Re-pitch in Warp Mode
2. close preferecnes.
3. re-launch Live (just to be safe)
4. open a fresh loop, and na da. no re-pitch. it is always Beat mode at 1/16 transients.

any ideas or is this a bug?
