True... I was a 'mug'.. I didn't 'think' in that moment..

However this NO excuse to RIP someone OFF! Taking advantage of people in this way is inexcusable..

You could report it to your bank who will stop payment on the transaction and leave Paypal holding the bag on the bad transaction, but if you take the issue out of Paypal's hands, they may be prickish about it and say something like they might cancel your account. In my opinion, account cancellation with paypal is acceptable over getting ripped off for 350 in any currency.

You both did break ebay rules though - never take transactions that start in ebay outside of ebay, ever.

Personally, I stick with Amazon whenever possible - they don't allow your payment to go to the seller until the seller has posted some sort of tracking info, adding that much more evidence in your favor should the seller try to screw you.

i'd say take it to the police mate, a denuncia should kick him into refunding - you've got a good virtual paper trail after all.

You can file a non received item complaint or whatever it's called with PayPal. Do this ASAP. There is a time limit, so do this ASAP. If that doesn't do it, you can escalate it to a claim. Luckily for you, PayPal is very buyer-centered, so it is likely you will receive money back, but it may take a while.

Email eBay's CS, report a dispute, and tell them about the situation. Do not reveal to them that you broke their TOS right away, let them assume you paid normally. If you have to give them the information, play dumb and claim that the seller sent you a fraudulent email, they broke eBay's TOS first so it's likely their fault and you will probably be OK.

Remember that there are time limits to everything, so read the instructions very carefully. 10 days for the dispute, then 45 for the claim (IIRC) and some other stuff too. If you miss these deadlines you are SOL. Also, you should be emailing everyone (PayPal, eBay, the seller) EVERY FUCKING DAY, asking them on the status of your claim or item. Seriously, probably even a few times a day. The more you annoy them the more likely they are to respond to you to shut you up. Be cordial, polite, and professional. Do not flame or you will look to be crazy and they will ignore you.

Finally, never pay with a direct transfer from your bank account. If you have a credit card, ALWAYS use that and pay off the balance each month. With a CC, you have an additional layer of protection. If you do not receive an item, you will be able to reverse the charges in many cases. This can take a while, but it does work. Lastly, NEVER carry a balance in your PayPal account. If something gets fucked up sometime, PayPal can much easily take money from your account to cover something, and you are unlikely to ever see that money again.

So go through the proper channels. If you don't see your money again, consider it lesson learned. At least it was only €350! There are many, many people who have been raped on eBay for much higher fees. Good luck, and fuck PayPal!

i dislike it for to many reasons to write on here, but one major one is that berlin does not develop or move on...
it is a giant village that claims to be one of the big leading international cities in this world...

i mean they closed a private jet airport 8O , how freakin' backwards is that? to many alternative assos (a german expression for low life people)
are here in this town... they where against olympia and stuff, too... but then moaning there is not enough work, etc. around and incomes are way under the german average, etc... it's a low life place, a giant toilet... and i am not posh, i am everything but posh, but to me in a real international big city everything 'balanced' from lowest low to highest high needs to be around me... and here the highest high is totally missing and to much of the lowest low is going on... i will never ever be in the situation of owning a private jet and i don't want to, but i like the possibility that people can have it here... in the end those are the once that move more then some low life living on the dole. i lived also in eastern europe and i am just not much of a fan of to much socialism shit around.

then again just recently someone said, you see that makes berlin so special compared to all other big cities in the world, it does not move...

he got a point there!!!

i was born here... left for 11 years (i could not stand it anymore) and came back a year ago... except a few buildings... well nothing changed, a big shock for me, though...

EDIT: in short i love all the alternative stuff that is going on here... i am a fan and i am an active part of it... but that does not mean i have to be aggressively against the opposite... that is just plain stoopid, nazi like one directional behavior, in that case those people who are against it are none better then the people they dislike... live and let die!

won ebay auction is kind of proof for paypal for transaction. now you can of course complain to paypal but my suggestion is to report it on nearest police station.

man.. a Midi guitar sounds cool... but I don't think they work that well...
try and get the money through paypal/your creditcard company
get the Interpol on his ass... !!!

I was duped for 40$ once ..
(I tried to buy GTAIV online when it came out..hehe)
I've contacted PayPal and the CreditCard company to let them know the scammers site...
never got the money back though..
the Internet is pretty much a scammers' paradise ... I mean...the guy could be in Iceland saying he's in Beijing..
so you need to watch out...
but eventually you're gonna need 'measured' leap of faith to actually pay...sucks

Buying anything through the internet, you have to be very careful.
Did you check out the guys selling history?
Buying outside of ebay was a bad mistake.

Read up on ways to reduce your exposure to these scamming muthafuckers.
There is a load of information out there to help you to help yourself when dealing with ebay transactions.

Sorry, but I don't like your chances of recovering your money.

Hard lesson, but you have to open your eyes.

Cheers guys for all your support and advice :) ..
I have started the transaction with Paypal to try and get a refund.. we'll see how that pans out..
Tomorrow I'm going to make a report with the police.. Spanish police.. hmmm .. we'll see on that one too!

I have bought quite alot of things online.. And never had any problems (until now).. I did have contact with the guy before I sent him the money.. Asking him questions about the guitar.. He was always good at replying.. BEFORE I sent him the cash..

I felt really pissed at first.. I still feel pissed.. It aint a good feeling, feeling like you've been fucked over.. People who do this shit to others are shit..
And, yes we do have to be cautious when buying online, esp ebay.. I wasn't this time and I've been burned (Hairspray revenge!! :twisted: jumps to mind here!!)

I hate to say this, but I don't think you're gonna get your money back. I've heard of scam after scam where people send money outside ebay and paypal, and they are fucked. A friend sold a synth for $3000, sent the synth. Never got paid.

He then saw his synth on ebay. Told the FBI and the law enforcement. They said they could do nothing, even though he was able to prove it with serial numbers.

Anyways, the botton line is that if you don't know someone, NEVER use cash. Always use some form of credit card, so that you can always do a chargeback. Even with Paypal, you can get Paypal credit and always use that.

I hope this works out for you, but I think your idea of showing up to his house with your friend Bruno is likely your best bet.

One other thing...when he asked for your account info, that's another tip that this was a total scam, and that you were about to lose more. I'm glad you used an unfunded account.
