Yeah, it's because you've somehow saved your current Live project as the default live set.
The easiest thing you can do is delete all the tracks so you have an empty arrangement, then if you want, create some blank audio / midi tracks that you always want to have appear when you first open the app or go to File > New Live Set. What you're doing is creating a template. So just as an example, I have say 4 audio tracks and 4 midi tracks preloaded with some common plugins that we use. Anyway, that's entirely down to you.
NOW... once you've done this, you need to go to Live > Preferences and click on the "File Folder" tab (4th one down on the left) and click the top Save button next to "Save Current set as Default".
That'll make sure that every time you boot Live or go to File > New Live Set, you'll get the template you've just created.
That's it. Note Live only allows you to create one default template.
Personally I couldn't care less if you're using pirated software. It's got nothing to do with the 2 very minor issues you're having in this case. But always best to upgrade to the latest version.
